1.1. We are Pepco Poland Sp. z o. o. (hereinafter referred to as “Pepco Poland”) based in Poznań, listed in the Register of Entrepreneurs kept by the District Court for Poznań-Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS no. 0000111962, NIP [Tax Identification Number]: 7822131157, REGON [Statistical No.]: 639669292, share capital: PLN 27,000,000, fully paid-in.

1.2. 2. WHAT DATA DO WE PROCESS AND FOR WHAT PURPOSES

2.1. In order to send our newsletter, we process the data provided directly by subscribers, such as:

- first name,

- e-mail address,

- post code,

- newsletter content preferences.

 

2.2. We collect the above data and process them solely in order to send our newsletter to the indicated e-mail address.

2.3. We can profile your personal data, which means that we may use the collected information, such as your post code and declared interests, in order to tailor the sent communications to your needs. In such case, however, we do not use your data for profiling consisting in making automated decisions which might affect your legal situation (i.e. we do not use algorithms to make decisions affecting your individual entitlements).

 

 

3. LEGAL BASIS FOR DATA PROCESSING

We process personal data under Article 6, Section 1, letter f) of GDPR,  based on legitimate interests of Pepco Poland. 

We send the newsletter only upon your freely given consent. You can withdraw the consent at any time.

3.1. We process the data necessary to send the newsletter under Article 6, Subsection 1, letter f) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (legitimate interests of the controller). In this case the legitimate interests of Pepco Poland consist in direct marketing of its products and services.

3.2. The newsletter is sent by e-mail upon unambiguous and documented consent of the subscriber, under Article 10 of the Electronic Services Provision Act.

3.3. The data are provided voluntarily. There is no legal obligation to provide personal data for marketing purposes.

5.1. Your personal data may be provided to processors which process data on behalf of Pepco Poland, among others to IT service providers and marketing agencies, and such processors process data under agreement with Pepco Poland and solely subject to Pepco Poland’s instructions.

5.2. Your data may also be provided to entities authorised to receive them under existing laws, for example law enforcement agencies at their request made under the relevant legal basis (e.g. for the purpose of pending criminal proceedings).

- right to access your data, including obtaining a copy of the data;

- right to rectification of the data;

- right to erasure of the data;

- right to lodge a complaint to the competent supervisory authority handling the protection of personal data;

- right to restrict data processing;

- right to withdraw consent to the extent in which the data are processed under that basis; withdrawal of the consent does not affect compliance with the right of processing performed based on the consent prior to withdrawal;

- right to data portability, i.e. to receive your personal data from Pepco Poland in a structured, commonly used and machine-readable format; you can transmit those data to another controller
